Step 1: File a Preliminary Notice (also known as a pre-lien) on the Utah State Construction Registry within 20 days of the date you first worked on or supplied materials or equipment to the property. To have Lien Utah prepare and file this notice for you, complete and return ORDER FORM 1 below.
Step 2: Record a Notice of Construction Lien with the county recorder’s office and serve the notice on the property’s owner by certified mail. This must be done within 180 days of completion of the project (or within 90 days of completion if a Notice of Completion was filed on the Utah State Construction Registry). To have Lien Utah prepare, record, and serve this notice, complete and return ORDER FORM 2 below.
Step 3: File a Lien Foreclosure Lawsuit within 180 days of completing step 2 to prevent your lien from expiring. Lien Utah does not provide legal services so it cannot help with this step. We recommend you use an attorney experienced in construction liens. If you need a referral, we can provide one.
Step 4: Release the Notice of Construction Lien once you have been paid. To have Lien Utah prepare and record the release, complete and return ORDER FORM 3 below.
